Should I Hire an Employee or a Contractor?


Are you confused about whether you should hire a contractor vs employee? If so, you’re not alone. Knowing when it’s time to hire a contractor instead of an employee is one of the most confusing aspects of employment for many businesses. Below we have provided some tips to help you sort through the confusion regarding independent contractor vs. employee hiring.

One of the most critical aspects of understanding contractor vs. employee hire is in understanding each are classified. If you should incorrectly classify someone as either one or the other, you could held liable for employment taxes as well as a penalty by the IRS.

The basic rule of thumb to remember when trying to determine whether someone is a contractor or not is by asking yourself whether you have the right to control or direct result of the work or the means and methods of accomplishing the result. If you only have the right to control the results of the work, then the individual is a contractor. However, if you have the right to control the means and methods by which the work is accomplished, then the person is an employee.

If you keep the rule regarding what you have the right to control and direct in mind, it will help you to remember the difference between employee and contractor hire. Knowing when and how to hire a contractor; however, requires understanding the various advantages and disadvantages of each classification.

One of the biggest myths regarding contractor vs. employee hire is that you won’t be required to deal with reporting income on contractors. This is only partially true. You are still responsible for reporting wages that you pay to an independent contractor if you pay that person more than $600 per year. This information is reported on IRS Form 1099-MISC, Miscellaneous Income.

When you make the decision to hire an independent contractor, it is always a good idea for both of you to sign an agreement putting forth the terms of your business relationship. This agreement should include the services which are to be performed, the timing regarding when the services are to be performed, specific information on the payment for the services, confidentiality, warranty and work for hire information.

If you are not familiar with the terms work for hire or you aren’t sure about what kind of confidentiality information you should include in an independent contractor agreement, take a look at these tips.

Generally, most independent contractor agreements include information that states the contractor is not allowed to use any proprietary information they learn about your company during the course of working for you that could be used for any other purpose than the benefit of your business.

Many business owners agree that starting a small business will involve the personal finances of the owner, even though the business may be formally regarded as separate entities. One of the first steps to do this would be to track your monthly expenses on a daily basis in order to adequately determine your actual personal costs. Once you have a clear idea where your monthly expenses go to, you can then create a budget for the period that your income may be affected. It may also be a good idea to pay off any outstanding debt such as home loans or car loans, so that you have less to pay for during the critical period.

It is of utmost importance that you ensure that you have enough to sustain you, as many new business owners overlook this factor, and end up going back to employment while still maintaining their business after a few months, due to the lack of personal funds.

Apart from that, if you are starting a business for the first time and are in need of obtaining a business loan, the bank or credit union will evaluate your application based on your personal credit rating. This is due to the fact the company’s credit history is not yet available for references by these financial institutions. Therefore, the best history that they can base their judgment on your creditworthiness would be the credit history of the business owner.

What is the implication of this? This means if you are planning to start a business and obtain financing for it, it is best for you to run a check on your credit report in the event of errors and flaws. There have been cases where loans were rejected due to an unfavorable credit report, which was actually due to errors made by the system. With this, months may be needed to correct these problems, which may cause delays for the business owner to obtain the required start-up funding for the new business.

In conclusion, the business is a separate entity when it is registered as a private limited company. Tips on Making your Way through the Murky Waters of Obtaining a Business License

While there are many duties and tasks to fill your hours and days when starting a business, one of the most important tasks that should be handled early on is to obtain a business license or business permit. Unfortunately, many people overlook this necessity and end up getting in legal trouble because they failed to do what was necessary to obtain a small business license.

If you aren’t familiar with the process of how to obtain a business license, we’ll provide you with a few tips below. First; however, let’s take a look at why it’s important to take care of handling your business license permit.
Business permits and business licenses are required by most city, county and state governments. Depending on your situation, you may also be required to obtain a business license or business permit by the Federal government. A local business license, issued by the county or municipal government is a general license that gives you the right to operate a business within the jurisdiction of that county or city. The fees are not usually expensive. This is what you’ll need to do in order to complete a business license application.

First, you’ll need to make sure that you have all of your business paperwork in order. Make sure that you have your Employer Identification Number, also known as EIN. Next, contact your county government or city hall office to find out exactly what kind of business license you need and to obtain a copy of the business permit application. After you have completed the application and filed it along with the appropriate fee, you’ll need to make sure that you stay on top of filing your business permit renewals. They do not automatically renew. This usually must be handled annually.

State business licenses and business permits are required for the operation of business that provide services or products that are regulated by State law. In addition, if your business is required to meet codes or standards, you will most likely be required to obtain a business license. Below are some tips on how to get a business license on the State level.

The process for obtaining a State business license is quite similar to obtaining a local business license. You will need to contact the appropriate office to determine what kind of license you need. Your local government may be able to help you with this. For example, if you are looking to obtain a California business license or business permit, you may need to contact the State of California. Beyond this, the process is exactly the same. File the appropriate paperwork and fee; then make sure you file your renewals each year.

One thing to keep in mind regarding business permit and business license is that they are different. While a business license allows you to legally operate a business within a jurisdiction; a business permit regulates safety and structure. For example, you may be required to obtain a business permit to purchase wholesale merchandise for resale, to remodel or build on a commercial site, to legally prepare food in a restaurant or to operate a business out of your home. Each of these situations requires a different type of business permit. Other than this, the procedure for applying for a business permit is almost exactly the same as applying for a business license.

Summary: Failure to obtain the right business law and/or business permit can lead to all kinds of trouble. By following these simple and easy to understand tips, you can make sure you have the right business permit or business license to protect your business.

What Information is Needed to Write a Marketing Plan

Creating a marketing plan for your business is crucial. Without one, it would be difficult for a business to generate revenue and successfully make a profit. It’s essential you devise a plan that will clearly define the value of your products or services, with the end result benefiting your customers.

Gathering What Counts

There are four major areas that you must have information about before creating a marketing plan: business resume`, target market, product message, and ‘how-to’ get the message to prospective customers (advertising).

Business Resume
: Clarity is the objective of a business resume`. Within the text, list the strengths of your product or service. Think of it as molding your knowledge. After all, would you write a marketing plan about something you know nothing about?

Target Market: Five simple questions will assist you in identifying your target market. Who are they? What is their age? What is the average income? What is their status? Do they have children? It’s important that you evaluate your target market to determine ‘what’ product or service would sell the best.

Product Message: A product message is a ‘direct call to action.’ This message must create value in the minds of everyone, that hears it, and for every feature, you offer a direct benefit to the customer must be demonstrated.

Advertising: Advertising is an appealing and compelling invitation to buy your product or service. It is an investment that should never be an expense. Finding the right advertisement takes trial and error, what marketers` refer to as “test” advertising. First time out of the box and you can’t expect immediate results.

Every business needs an outline of how they plan to approach the market. Make certain that you address the following questions in the process.

1. What medium is the most popular among your target market? (TV or Radio)
2. What is the percentage of participants in watching or listening to these mediums?
3. Do they read the local paper or magazine?
4. Should you consider direct mail?

Think of writing a marketing plan as breaking down the important elements and charting a path to success. These strategies will be of great assistance when faced with possibility of failure. Around that time I saw a television interview with Bill Gates. Although it was fairly early in his Microsoft career, he was already a very successful businessman. The interviewer asked him "Mr. Gates, what is the single most important thing that you can attribute your success to? Wow, that question really got my attention.

I stopped dead in my tracks. I just HAD to learn the secret to Bill Gates' success from the man himself.

Instantly, my mind started to race ahead. I figured he'd talk about things like perseverance and hard work, dedication and being a visionary. After all, he is responsible for bringing a whole new industry into being. But Bill Gates mentioned none of that. Instead, what he said blew my mind and put my career on a whole new path.

    Improve Marketing Techniques
    Marketing basics consist of two significant approaches to marketing: shotgun and rifle. Each approach to advertising or lead generation is unique. It’s up to your to determine which one suits your industry best.

    Rifle Approach
    The least expensive marketing approach is the rifle. Businesses that choose this approach are able to select their target market (niche group). Developing a compelling message to address the audience is the next step. In some circles, this is ‘Direct Marketing’.

    Identify the target market’s lifestyle and demographic related markets for your business. The target market could consist of the following:

    · Women
    · Men
    · Professionals
    · Homemakers
    · Middle-class
    · Upper-class
    · Age groups

    You get the idea. Of course, not all niche groups fit every industry.

    Addressing Your Market
    To target your niche group, start with identifying resources that can supply the target pathway for your message.

  • Direct mail

  • E-mail marketing

  • TV or radio broadcast

  • Web site


  • Take time to research magazines that specialize in your industry. Even the Internet provides a variety of resources to hunt down and analysis your target market. Resources like these can give you fresh ideas of effective direct marketing techniques.

    There are other useful tools implemented to drum up business. Of course, what you use and how you use it relies highly on the industry your in. For instance, a professional wouldn’t put a banner outside of his/her office to draw up business. But a fitness professional may find a banner outside of the club works wonderfully.

                Internet Explorer: Benefit Analysis versus Firefox


                Microsoft Internet Explorer (MSIE) is very much the incumbent in the web browser arena. Before the arrival of Firefox, MSIE had estimates of >97% of market share. Firefox has cut into MSIE's marketshare, dipping MSIE usage below 90% in the US, and down to the 60% range in markets such as Germany.

                Most of MSIE's advantages are Firefox's disadvantages, and vice-versa. This article will discuss some advantages and disadvantages of MSIE in relation to Firefox.

                Advantages
                Integration with other Microsoft productsMicrosoft often offers its customers good integration among its products, and MSIE is no exception. One can drag an Excel bar graph from an MSIE webpage onto an existing Excel document, or view a Microsoft PowerPoint presentation from within MSIE. Within a Microsoft-only corporate intranet, this integration is very helpful. However, for a business interacting with the outside world, the argument weakens since the foundation of the Internet is to share among different platforms. Outside users expect documents to be in platform-agnostic formats such as HTML or Acrobat PDF files.

                MSIE also offers strong integration with its Microsoft operating system, though is a double-edged sword, since it contributes to its security woes.

                ActiveX and VBScript supportActiveX refers to small Windows executable programs that can be run from MSIE, and VBScript is a client-side script for Windows code.

                Some business have heavily invested in either developing or purchasing custom ActiveX software (and/or VBScript), for applications ranging from web-based accounting to e-learning simulators.
                The Firefox team made a conscious decision to support neither ActiveX nor VBScript, since they are not accepted web standards and are often the source of the security vulnerabilities within MSIE.
                Since Firefox will not likely ever support ActiveX and VBScript, businesses whose products revolve around these technologies would be better served with MSIE than with Firefox.
                Still some MSIE-only webpagesSince MSIE formerly had such a large marketshare, some businesses' webpages still only display correctly in MSIE.

                However, Firefox's increasing marketshare has caused many companies to revamp their pages to work correctly in Firefox also.

                There are several reasons. Businesses want to ensure that they can sell to the Firefox customers. Moreover, many of the users who purchase with credit cards have moved to Firefox because of the extra security for that sensitive transaction. Finally, many businesses see that it costs less to fix the pages, than to cover the "Why doesn't work in Firefox?" technical support calls support calls.

                Arrives with a new Windows computerMSIE arrives installed new Windows and Mac computers; Firebird does not.
                However, the initial MSIE is unpatched and thus riddled with security holes. Thus, novice Windows users are often disappointed as their computers become increasingly unresponsive with viruses and spyware.

                Thus, the convenience of having MSIE preinstalled on Windows is minimal, since Firebird can be downloaded and installed about as easily as patching the initial insecure MSIE.

                Microsoft has ceased new development of MSIE for the Mac, so it has decreasing usefulness on the Mac as an out-of-box browser.

                Disadvantages
                Closed source and tied to a U.S. companyClosed source prevents users from reviewing the code to ensure that there are no security backdoors included in the software.

                This is particularly important for Internet communication software, as the U.S. government may approach Microsoft to either divulge or include security backdoors that can be used for information surveillance, especially on foreign governments or high-risk suspects. Some governments don't want to have a foreign country’s closed source software at the heart of their information network. This may partially account for the higher adoption rate of open-sourced Firefox in countries outside the U.S.

                Selling of other Microsoft items and forced end-of-lifePart of any corporation's mission is to maximize profits. For Microsoft, this includes selling the maximum number of its own products and services.

                So to use the newest MSIE, one has to purchase a license of their newest OS. MSIE's built-in search only works with Microsoft's MSN search, versus Firefox's built-in search toolbar that uses technically superior Google as the default and is user-selectable.

                Moreover, since MSIE is closed-source software, users always face the possibility of forced end-of-life of the MSIE software and anything the user has built around it.

                Total cost of ownershipBoth browsers can be downloaded and used free of charge, so their initial cost is equal.
                For technical support questions, both are widely enough used that many solutions to common problems can be found in free online public forums. Telephone support for Firefox costs $39.95 per incident, and Microsoft costs between $35.00 per incident and can cost over $200.00 for advanced issues.

                However, MSIE has heavier ongoing support costs due to the nearly monthly security patches that are required. Also, there are ongoing costs from lost work time due to the poor stability and viruses when using MSIE. Finally, with MSIE requiring the newest version of their operating system, it forces the total cost of ownership to include the cost of updating all licenses to Windows XP SP2.

                International Trade


                Breaking into the international marketplace can catapult a company into increased profitability and growth more rapidly than when selling to a domestic market.

                But how do you market your company successfully to overseas buyers? What can you do to provide the right information to prospective clients that are informative and engaging? How can you stand out from the crowd?

                The most common promotional approach is to provide brochures. While brochures do play an important role, they can be uninspiring and ill equipped way to convey a real feeling for what an organization does and how they operate.

                If you operate a small business, you may feel that your income potential is quite limited. However, you can increase and diversify your income through international trade.

                1. Importing

                Retail store owners can find additional products to sell from foreign manufacturers, distributors, and other suppliers.
                Advantages of importing include increased product selection, lower costs, and increased income.
                You may even decide to go exclusively into the import business and become a wholesale distributor.

                2. Exporting

                Manufacturers can find new customers for their products in foreign countries.
                Perhaps consumers in your country have lost interest in your product. It may have become obsolete because of technological advances. A foreign market, however, may be desirous of that very product.

                Maybe there is an economic slump in your country. Another country may be experiencing a boom. Sales from customers in that country may help stabilize your income.

                Exporting can also help smooth the peaks and valleys of your income. For instance, if you sold winter sporting goods, you could sell to both northern and southern hemispheres to help offset the seasonal nature of your business.
                Of course, you might also consider selling sporting goods for all the seasons and still export to other countries to increase and diversify your income.

                You could also become an Export Management Agent. Arrange for other domestic companies to sell their products to foreign corporations and earn a ten percent commission.

                You would think that selling to foreign customers would be quite risky. However, use of letters of credit can protect all parties. An Export Management Agent might actually arrange for ninety percent of the sale to be paid directly to the domestic supplier and ten percent to be paid directly to him.

                3. Licensing

                Consider becoming a licensing agent. Earn royalties by arranging for foreign corporations to manufacture and sell the products of domestic companies.

                4. Finder’s Fees

                Imagine the possibilities for earning finder’s fees in international trade!

                You can earn fees from domestic companies for finding foreign buyers (or for finding suitable imports from foreign suppliers). You can also earn fees from foreign companies for finding domestic corporations that will buy their products (or for finding suitable suppliers and products from domestic corporations).

                5. Drop Shipping

                Visualize receiving an order from a customer based in a foreign country and not having to be bothered with shipping and handling the product. No customs declarations or brokers are required by you. This is because your drop ship supplier is handling those details.

                You might collect $100.00 plus shipping of $15.00 from your foreign customer. You then simply send your customer’s order to your drop ship supplier with your payment of $65.00 (consisting of $50.00 wholesale cost plus $15.00 shipping). Your drop shipper will now fulfill the order. Congratulations! You just made fifty dollars.

                6. Mail Order

                Add a mail order service to your existing business operation. Manufacturers, retail stores, and other businesses can increase their sales by using this additional method of selling that is very conducive to international trade.

                7. Internet Marketing

                You can also extend your reach to worldwide customers by means of the Internet. Methods of obtaining foreign business include affiliate marketing, online auctions, online stores, and websites.

                Firefox, the open-source web browser from the non-profit Mozilla corporation, continues to make headlines with its ever-increasing market share versus Microsoft's Internet Explorer (MSIE).

                Most of Firebird's advantages are MSIE's disadvantages, and vice-versa. This article will look at some of the advantages and disadvantages of Firefox in relation to MSIE.

                Advantages
                Security is often cited as the primary reason for users switching from MSIE to Firefox. Security is of utmost importance for software that interacts with remote computers, in an era of high security risk activities such as online banking.

                Firefox has fewer security holes and a tighter schedule of disclosing them. The enhanced security in Firefox is due to a multitude of factors the system's inclusion of more source code reviewers and a better bug reporting system and exclusion of VBScript/ActiveX, often the source of vulnerabilities.

                Meanwhile, Microsoft has been clamoring for years to try to clamp down on the MSIE security holes. It acquired an anti-spyware product, which it released under the banner of Microsoft AntiSpyware. It also promises its new Windows Vista platform will be more secure. However, Microsoft's track record to date has done little to boost the confidence of today's user.

                Standards compliance
                Firefox has vaulted ahead of MSIE with improved support for standard web protocols, such as its superior stylesheet compatibility.

                Since MSIE had a leading marketshare, the company had less interest in conforming to web standards, and instead focused on proprietary protocols, with the goal of maintaining their market position. That is, the focus of Microsoft was to try to convert as much of its userbase to writing webpages and web applications that required a proprietary MSIE-approach, so that down the road, users would be less able to move off a Microsoft platform.

                As a result, Microsoft neglected for years to improve support for basic open standards. For example, transparent PNG graphics did not work all the way through to MSIE version 6.

                Multiple operating system platforms
                Firefox is available for users who runs Windows (Windows 98 through to Windows XP), Mac OS X, all the leading versions of Linux, as well as some lesser-used operating systems. In comparison, Microsoft has dropped development for Mac, and other non-Windows systems. Furthermore, Microsoft has ceased new development even on their own versions of Windows, making the new MSIE only available to users who have a license for Windows XP.

                Firefox also has a similar user interface among the different operating platforms. For deployments that have a mix of operating platforms (such as Linux for the techs, Macs for the graphic designers, and Windows for the accounts department), moving to Firefox for everyone thus brings technical support costs down.
                Time-saving browser innovations
                Internet communication and interaction is a core component for most modern businesses. Efficient use of web browser time translates to increased profits, so innovations to help workers do their tasks faster are welcomed.

                Firefox leads MSIE in this regard, with out-of-the-box features such as integrated Google search in the toolbar, placing the find-within-page box at the bottom of the browser window so as not to obscure the text, and so on.

                Disadvantages-Retraining
                Any switch of software incurs a retraining cost. However, a switch from MSIE to Firefox requires only a mild amount of retraining.

                The switch from MSIE to Firefox is designed to be easy, with proper import of bookmarks and other settings.
                Browser interfaces are becoming standard, so understanding how to get up and running is not usually a problem. There are some only minor adjustments. For example, "Internet Files" in MSIE is called "Cache" in Firefox. One can use a downloaded MSIE theme so that the Firefox user interface even more closely resembles that of MSIE.

                Incomplete migration
                In a business with Windows computers, if the switch from MSIE to Firefox is incomplete, it can cost more to offer technical support for both browsers. This argument would only apply to shops whose Windows computers are all Windows XP. Since the new MSIE is only available for Windows XP, if there are different Windows versions (such as Windows NT or 2000), then the technical support team already needs to support different types of MSIE browsers.

                Another consideration, however, is that even an incomplete switch from MSIE to Firefox could result in less technical support, since the Firefox users would be less likely to need help with fixing their computer after an MSIE-related security breach.

                Finding the right employee can be a piece of cake when you know where to look and how to look. By understanding the advantages and disadvantages of the most popular ways to conduct an employee search you can better increase your chances of finding a good employee. Finally, by knowing how to recruit new employees, not just hire them, you can save yourself a lot of trouble in the end.

                The process of finding the right employee is a daunting task for many employers who are unsure how to go about the task, or even where to begin. Fortunately, there are a number of services and methods available that can make an employee search much simpler.

                Of course, one of the most popular methods for recruiting employees is to use the traditional help wanted poster and classified listing. It should be noted; however that this method really only works well if you have a traditional storefront with a brick and mortar building. In addition, you should be aware that with this type of employee search you are generally only going to receive the most general and traditional recruits. While this is a reliable, and free, method for finding employees; you are much more likely to attract applicants who are unqualified and who may have questionable work ethics.

                Public services can make the process of finding good employees a little easier without spending any money doing it. This is because each state has an employment service office that can help you with your employee search. These offices are often referred to as the ‘unemployment office’; a nickname most states would like to do away with. In reality, these offices are affiliated with the United States Employment Service and Department of Labor. They can help you with everything from screening applicants with aptitude tests to actually receiving resumes and applications for you so that you don’t have to interrupt your daily business operations with the inundations. Best of all-these services are completely free.

                If you want to step up your efforts in finding the right employee, you might consider a fee based search. Employment and recruitment agencies handle screening, background checks and aptitude tests in order to help you in finding good employees. They can also provide advise to you on how to recruit employees. Be aware, though; this service will cost you.

                Temporary personnel services are also a solution that may be able to help you in finding employees. This type of services normally works better if you are experiencing a temporary labor shortage rather than a permanent staff person; however. The big benefit to using a temporary personnel service is that they will generally handle multiple tasks such as payroll, tax deductions, fringe and other costs associated with an employee.

                So, once you have decided how you are going to go about finding employee; do you know how to recruit a new employee? Do you know what to look for in a candidate to know whether they will make a dedicated employee?
                Unfortunately, many companies and organizations rush into the hiring decision in an effort to alleviate labor shortage problems without giving any real thought to beyond whether the person has the skills and is available to whether they will make a truly good employee or not.

                Many of these problems can be alleviated with a good solid interview and background check. A good interview involves more than asking when a candidate can start to work and whether they have the requisite experience. You need to delve into their motivations and determine whether they will be a good fit for your team. Furthermore, a rushed timeline is no reason not to perform a background check. It may take a little longer but the wealth of information you can uncover regarding a candidate in a background check can save you multiple headaches down the road.
